Terms and conditions
1. DEFINITIONS
| 1.1 | ‘the seller’ means Security Posts Direct Ltd’. |
| 1.2 | ‘the buyer’ means the person, firm or company with whom this contract is made. |
| 1.3 | ‘the contract goods’ means the goods subject of the contract between the seller and the buyer. |
2. PRODUCTS & PRICING
| 2.1 | The seller takes every care in the preparation of the content of this website, in particular to ensure that the prices quoted are correct at time of publishing and all products have been fairly described. However, please note the following. |
| 2.2 | Colour and appearance on the website will vary according to the resolution and the screen type of your computer. Therefore, the seller cannot guarantee that the appearance or colours of the products shown on the site exactly reproduce the appearance or colours of the products themselves. |
| 2.3 | The weights, dimensions and capacities given are approximate only. |
| 2.4 | The prices the buyer pays at the time the seller receives the order are the same as advertised on the seller’s website. If an error has been made the seller inform the buyer to give the option or either accepting or cancelling the order. |
| 2.5 | The prices given by the seller in all quotations are valid for 30 days. After that period increases may be applied. |
| 2.6 | All prices are exclusive of VAT at the rate applicable. |
| 2.7 | For account clients, the seller reserves the right to charge daily interest at a rate of 4% above Barclays Bank Plc base rate. |
| 2.8 | Goods are supplied with free delivery unless otherwise stated. |
| 2.9 | Credit and debit card payments will be charged immediately to authorise despatch of goods. The seller accepts Visa Credit, Visa Debit, Mastercard, Visa Electron, Switch/UK Maestro, Solo, Maestro and JCB. Pro-forma’s can be paid either by card over the phone or by BACS: National Westminster Bank Plc, Sort code: 55-81-42, Account No: 90776739 or cheque payable to Security Posts Direct Limited and sent directly to: Security Posts Direct Ltd, Unit 10, Glan Don Industrial Estate, Pwllheli, Gwynedd, LL53 5YT. |
| 2.10 | By giving card details to the seller to pay for an order, the buyer is guaranteeing that the card being used belongs to the buyer. All cardholders are subject to validation checks and authorisation by the card issuer. |
| 2.11 | Title of goods will not pass until the seller receives cleared funds. |
3. DELIVERY & RETURNS
| 3.1 | The buyer shall notify the seller in writing of any loss or damage to the supplied goods within 48 hours of delivery. In the absence of such notice, it will be deemed that the buyer has accepted the supplied goods. |
| 3.2 | The seller cannot be held responsible for late delivery times. |
| 3.3 | The seller reserves the right to cancel any order if goods that have been ordered have been listed with an incorrect price either by the supplier or its suppliers. |
| 3.4 | The supplier cannot be held responsible for damages arising from goods in transit. |
| 3.5 | Should the buyer cancel the order with the supplier then, when the buyer receives the goods they must be unopened and remain in their original packaging, and must be returned to the contact address quoted on the buyers transit document, at the buyers own risk and cost. |
| 3.6 | On receipt of the returned goods, in good order as 3.5 above, then the supplier will raise a credit accordingly. Should the buyer return the goods and do not pay the transit costs the seller will deduct the value of the transit costs from the amount due to the buyer. |
| 3.7 | The delivery charges incurred in sending the goods to the buyer will be deducted from any refund given. |
| 3.8 | Should the goods returned arrive damaged, then the buyer will be liable for the cost of the goods in full. |
| 3.9 | There will also be a restocking fee liable of 25% of the contract value. |
| 3.10 | Any credits/refunds will be processed within 30 days. |
| 3.11 | No compensation is applicable. |
4. SELLER’S WARRANTY
| 4.1 | If within a period of 6 months of commissioning the contract goods the same require repair or replacement due solely to a fault in the contract goods provided that:- |
| 4.2 | The seller’s liability shall be limited to the repair or replacement of the contract goods and not further or otherwise, and |
| 4.3 | For the avoidance of doubt the seller will not be liable for any reason for any repair or replacement made necessary as a result directly or indirectly of any abuse of the contract goods, or as a result of faulty or incorrect installation by an agent or contractor of the buyer not approved by the seller for the installation of the contract goods. |
| 4.4 | The seller shall not be liable in any way whatsoever for any loss, damage or injury caused by accident or by any third party whether trespassers or otherwise. |
| 4.5 | The contract goods are designed to be a deterrent to unauthorised access by the seller gives no warranty that the installation of the contract goods will prevent unauthorised access and save only to the extent that liability cannot lawfully be excluded the seller shall not be liable for any loss or damage whatsoever arising out of or as a result of unauthorised access to the buyers property or any unauthorised interference with the contract goods. |
5. LIMITATION OF DAMAGES
| 5.1 | Save as provided in 4.1 the seller, its agents or sub contractors shall have no liability under the contract for any personal injury, death, loss or damage of any kind whatsoever whether consequential or otherwise, including but not limited to, loss of profits and so far as law permits the seller hereby excludes all conditions, warranties, stipulations, express or implied, statutory, customary or otherwise which, but for such exclusions might subsist in the buyers favour. |
| 5.2 | Neither the seller, its servants, agents or sub contractors shall be liable for any loss or damage of any kind whatsoever (except arising from death or personal injury) whether consequentially or otherwise caused directly or indirectly by any negligence on the sellers part or on the part of any of the sellers servants, agents or sub contractors in connection with or arising out of the manufacture, supply or installation of the contract goods. |
6. LAW
| 6.1 | These Terms and Conditions are subject to English Law and any disputes arising under them shall be submitted to the jurisdiction of the Courts of England and Wales. These Terms and Conditions do not affect your legal rights. |
